LEGAL NOTICE
Subject: Legal Notice for Recovery of Outstanding Payment
Dear Sir/Madam,
I, [Your Name], son/daughter of [Father's/Husband's Name], CNIC No. [Number], proprietor of the online store "[Your Online Store Name]" operating through [website / Instagram / Facebook / marketplace page], engaged in the sale of [goods/services], having its business address at [Street Address], Faisalabad, Punjab, Pakistan, do hereby serve upon you the following legal notice on the facts and grounds stated below:
1.    That you placed an order bearing Order/Invoice No. [Number] dated [Date], for [description of goods/services], for a total amount of PKR [Amount] ("the said amount"), through my online store.
2.    That in pursuance of the said order, I duly delivered the said goods/services to you on [Delivery Date], as confirmed by [delivery receipt / courier tracking / your own acknowledgment], and you accepted the same without raising any objection as to quality, quantity, or condition.
3.    That despite delivery of the said goods/services and repeated reminders sent to you on [Dates] through [WhatsApp/call/email], you have failed and neglected, and continue to fail and neglect, to pay the outstanding amount of PKR [Amount], although the same is due and payable.
4.    That your conduct amounts to a wrongful neglect and refusal to pay for goods sold and delivered, entitling me to sue for the price of the goods under Section 55 of the Sale of Goods Act, 1930.
5.    That the order and the communications between us, having been made through electronic means, are fully recognized and admissible in evidence under the Electronic Transactions Ordinance, 2002, and I am in possession of the order confirmation, chat/email correspondence, and payment records evidencing this transaction.
6.    That your default also constitutes a breach of contract under the Contract Act, 1872, entitling me to claim compensation under Section 73 thereof, in addition to the principal amount due.

NOW, THEREFORE, you are called upon to pay the outstanding amount of PKR [Amount] (Rupees [Amount in Words] only) to me within fourteen (14) days from the date of receipt of this notice, through [bank transfer to Account No. ____ / cash / other agreed mode], failing which I shall be constrained, without any further notice, to institute a civil suit for recovery of the said amount along with mark-up, damages, and costs of litigation, under the Sale of Goods Act, 1930, the Contract Act, 1872, and the Code of Civil Procedure, 1908, before a court of competent jurisdiction, entirely at your risk, cost, and consequences.

A copy of this notice, along with all supporting documents referred to herein, is retained on record for future reference and evidence.

Subject: Legal Notice for Unauthorized Use / Infringement of Trade Name and Brand
Dear Sir/Madam,
I, [Your Name], son/daughter of [Father's/Husband's Name], CNIC No. [Number], proprietor of the online store "[Your Online Store Name]" operating through [website / Instagram / Facebook / marketplace page] ("my brand"), do hereby serve upon you the following legal notice on the facts and grounds stated below:
1.    That I am the proprietor and lawful owner of the online store/brand "[Your Online Store Name]", and have continuously and extensively used the said name, logo, and associated branding in connection with the sale of [goods/services] since [Month/Year], thereby acquiring substantial goodwill and reputation among the consuming public. [If applicable: the said trademark is registered with the Intellectual Property Organization of Pakistan (IPO-Pakistan) under Registration No. [Number].]
2.    That it has come to my knowledge that you are operating an online store/page/account under the name/mark "[Infringing Name]" at [URL / social media handle], which is identical or deceptively similar to my store name, logo, and overall presentation, and is being used in connection with similar or identical goods/services, causing confusion among consumers and unlawfully trading upon the goodwill I have built.
3.    That the aforesaid acts constitute infringement of my trademark under Sections 39 and 40 of the Trade Marks Ordinance, 2001 [if registered], and/or passing off of your business and goods as mine, which is actionable under the said Ordinance and the common law of passing off, regardless of registration.
4.    That your unauthorized use and replication of my brand name and identity on digital platforms further amounts to unauthorized use of identity information, an offence under Section 16 of the Prevention of Electronic Crimes Act (PECA), 2016. [If your logo, product photos, or written content have also been copied: this further amounts to infringement of copyright under the Copyright Ordinance, 1962.]
5.    That your conduct has caused, and continues to cause, irreparable loss and injury to my business, reputation, and goodwill, for which you are liable in damages.

NOW, THEREFORE, you are called upon to, within fourteen (14) days from the date of receipt of this notice: (a) immediately and permanently cease and desist from using the name/mark "[Infringing Name]" or any name/mark identical or deceptively similar to mine, on any website, social media platform, marketplace, packaging, or advertisement; (b) take down all online listings, pages, posts, and advertisements bearing the said name/mark; and (c) confirm the above in writing to me — failing which I shall be constrained to initiate civil proceedings for a permanent injunction, damages, and rendition of accounts under the Trade Marks Ordinance, 2001, before the competent Tribunal/District Court, and/or lodge a complaint with the Federal Investigation Agency (FIA) Cybercrime Wing under the Prevention of Electronic Crimes Act, 2016, entirely at your risk, cost, and consequences.

A copy of this notice, along with all supporting documents referred to herein, is retained on record for future reference and evidence.

LEGAL NOTICE
Subject: Legal Notice for Breach of Contract — Non-Delivery / Defective Supply of Goods
Dear Sir/Madam,
I, [Your Name], son/daughter of [Father's/Husband's Name], CNIC No. [Number], proprietor of the online store "[Your Online Store Name]", do hereby serve upon you the following legal notice on the facts and grounds stated below:
1.    That I entered into an agreement/purchase order with you, vide Purchase Order/Invoice No. [Number] dated [Date], for the supply of [description of goods] against payment of PKR [Amount], which I duly paid to you on [Date] through [bank transfer / online payment], as evidenced by [receipt / bank statement / screenshot].
2.    That under the said agreement, you were obligated to deliver the said goods to me on or before [Date]; however, you have, without lawful justification, failed to deliver the said goods / delivered goods that are defective, of inferior quality, or not in conformity with the agreed specifications, despite my repeated requests and reminders dated [Dates].
3.    That your conduct amounts to breach of contract and failure to fulfil the implied conditions as to quality and fitness under Sections 14 to 17 of the Sale of Goods Act, 1930, entitling me to claim damages for non-delivery under Section 57 of the said Act, and/or to treat the contract as repudiated and claim a refund of the amount paid.
4.    That I have suffered financial loss and business/reputational damage on account of your default, for which you are liable to compensate me under Section 73 of the Contract Act, 1872.

NOW, THEREFORE, you are called upon to, within fourteen (14) days from the date of receipt of this notice, either (a) deliver the said goods strictly in conformity with the agreed specifications, or (b) refund the entire amount of PKR [Amount] paid by me, along with compensation for the loss suffered — failing which I shall be constrained to institute a civil suit for recovery, damages, and/or specific performance under the Contract Act, 1872, the Sale of Goods Act, 1930, and the Specific Relief Act, 1877, before a court of competent jurisdiction, entirely at your risk, cost, and consequences.

A copy of this notice, along with all supporting documents referred to herein, is retained on record for future reference and evidence.
